Terms and Conditions – Vesterez

These Terms and Conditions govern the sale of products through the website vesterez.com. By placing an order you accept these terms in full.

Business activity: design, commercialization and online sale of textile garments, fashion products and accessories.

2. Scope

These terms apply to every purchase made on this website. They complement, and must be read together with, our Shipping Policy, Returns & Exchanges Policy, Privacy Policy and Legal Notice. Where a specific policy contradicts these terms, the specific policy prevails on that particular matter.

We may update these terms at any time. The version applicable to your purchase is the one published on the website when you place your order.

3. Who can buy

To place an order you must be at least 18 years old and legally able to enter into a binding contract. By ordering you confirm that the information you provide is accurate and complete.

4. Products and availability

Product images are for illustration purposes. Slight variations in colour may occur depending on your screen settings, and small differences in print placement are inherent to the manufacturing process and do not constitute a defect.

All products are subject to availability. If an item becomes unavailable after your order, we will inform you and refund the amount paid for that item.

5. Prices and taxes

Prices are shown in the currency of your market and include applicable VAT unless stated otherwise at checkout. Shipping costs, where applicable, are shown before you confirm the order.

Orders shipped outside the European Union may be subject to import duties, taxes and customs fees charged by the destination country. These are not included in the price and are payable by the customer, as detailed in our Shipping Policy.

We reserve the right to change prices, promotions and availability at any time. Changes do not affect orders already confirmed.

If an item is displayed at a manifestly incorrect price due to an obvious error, we may cancel the order and refund you in full, informing you beforehand.

6. Placing an order

The purchase contract is formed when we send you an order confirmation by email. Adding items to the cart does not reserve stock.

Before confirming payment you can review and correct the contents of your order, the quantities, the shipping address and the billing details.

We may decline or cancel an order in cases of suspected fraud, payment failure, obvious pricing errors, or where we are unable to ship to the address provided.

7. Payment

Payment is processed by the payment providers enabled at checkout. We do not store your full card details; payments are handled by the provider under its own security standards.

The order is processed once payment is authorised.

8. Multi-unit offers

Where a multi-unit offer applies (for example two or three items at a reduced total price), the discount is applied automatically at checkout when the required quantity is in the cart. The reduced price applies to the order as a whole. If a partial return is made, any refund is calculated on the amount actually paid for the returned item within the offer, not on its individual list price.

9. Shipping and delivery

Processing and delivery times, tracking, responsibility after delivery and incorrect addresses are governed by our Shipping Policy. As a guide, processing takes 2–6 business days and delivery 4–8 business days depending on destination.

Risk of loss passes to you upon delivery.

10. Right of withdrawal and returns

If you are a consumer resident in the European Union, you have the right to withdraw from the contract within 14 calendar days from the day you receive the goods, without giving any reason.

To exercise this right, contact us at no_reply@vesterez.com stating your order number before the deadline expires. Items must be returned unworn, unused, in perfect condition and with all original tags and packaging.

Return shipping costs are borne by the customer where the return is due to a change of size or personal preference, and by Vesterez where the item is faulty or we made an error. Refunds are issued to the original payment method within 5–10 business days of receiving and inspecting the return.

11. Legal guarantee

Products benefit from the legal guarantee of conformity provided by applicable consumer law. If an item is faulty or does not match its description, contact us at no_reply@vesterez.com with your order number, photographs and a description of the issue, and we will resolve it at no cost to you.

The guarantee does not cover normal wear and tear, damage caused by misuse, or damage caused by washing contrary to the care instructions.

12. Intellectual property

All designs, graphics, texts, photographs, logos and other content on this website are the property of VESTEREZ S.L. or are used under licence, and may not be reproduced, distributed or used commercially without prior written permission.

Products sold on this website are original designs by Vesterez. Any reference to television series, films or other cultural works is made in a descriptive and artistic sense and does not imply any affiliation with, endorsement by, or sponsorship from their rights holders.

13. Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under applicable law.

Subject to the above, we are not liable for delays or failures caused by events outside our reasonable control, including carrier disruptions, customs procedures, extreme weather or strikes.

14. Personal data

Personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).

15. Complaints and dispute resolution

You can send any complaint to no_reply@vesterez.com and we will respond within 24–72 business hours.

Consumers resident in the European Union may also use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.

16. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute will be submitted to the courts that correspond under applicable consumer legislation, which for consumers is normally the court of their place of residence.

17. Nullity

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
